Terms and Conditions

Last updated: 7 October 2026

These Terms and Conditions govern your access to and use of the EcoComply website, platform, content, databases, tools, resources and associated materials (“EcoComply”).

By accessing or using EcoComply, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you should not use EcoComply.

EcoComply is operated from Scotland by Joseph Mangham-Brown.

For the purposes of these Terms, references to “EcoComply”, “we”, “us” or “our” mean the owner and operator of the EcoComply platform.

1. About EcoComply

  • related professional and educational material.

EcoComply is intended to provide a practical reference and knowledge resource.

It is not a substitute for project-specific professional advice, legal advice, regulatory advice or competent professional judgement.

2. Intellectual Property Rights

Except where expressly identified as third-party material, all intellectual property rights subsisting in EcoComply and its original content, structure and materials are owned by, or validly licensed to, the EcoComply owner/operator.

This includes, without limitation:

  • the EcoComply name, logo, branding and visual identity;

  • original website and platform text;

  • articles, summaries, profiles and explanatory content;

  • practitioner guidance and compliance information;

  • graphics, diagrams, illustrations and visual materials;

  • original tables, matrices and comparison frameworks;

  • environmental compliance frameworks;

  • decision trees and decision-support pathways;

  • the selection, categorisation, hierarchy and arrangement of information;

  • relationships established between different areas of environmental information;

  • database structures;

  • datasets and compilations where intellectual property or database rights subsist;

  • the selection and arrangement of database contents;

  • information architecture;

  • navigation systems;

  • platform architecture;

  • page structures;

  • interface structures and original user-interface elements;

  • downloadable documents and resources;

  • original educational materials;

  • research materials;

  • original platform concepts and presentation methods;

  • website layout and original design elements; and

  • any other original material created for EcoComply.

These materials may be protected under applicable intellectual property law, including the Copyright, Designs and Patents Act 1988, the Copyright and Rights in Databases Regulations 1997, and other applicable UK intellectual property legislation.

All rights are reserved.

Nothing contained within EcoComply or these Terms transfers ownership of any EcoComply intellectual property to any user.

3. EcoComply Branding

The EcoComply name, logo, branding, visual identity and associated identifiers may constitute trade marks, copyright works or other protected commercial identifiers.

You must not use, reproduce, modify or imitate EcoComply branding in a manner that:

  • implies ownership of EcoComply;

  • suggests an affiliation that does not exist;

  • suggests endorsement by EcoComply;

  • creates confusion with EcoComply;

  • misrepresents the source of material; or

  • is used commercially without prior written permission.

Nothing in these Terms should be interpreted as representing that a trade mark is registered unless expressly stated.

4. Database Rights

EcoComply may contain databases, datasets and systematically or methodically arranged collections of environmental information.

Where copyright, database rights or other intellectual property rights subsist in those materials, those rights are expressly reserved.

This may include rights relating to:

  • database structure;

  • selection of information;

  • arrangement of information;

  • classification;

  • categorisation;

  • compilation;

  • indexing;

  • taxonomy;

  • relationships between records;

  • jurisdictional mapping;

  • environmental compliance pathways; and

  • investment made in obtaining, verifying, presenting or maintaining database contents.

Users must not, without prior written permission:

  • extract all or a substantial part of a protected EcoComply database;

  • reutilise all or a substantial part of a protected database;

  • repeatedly or systematically extract parts of a database in a manner which conflicts with applicable database rights;

  • reconstruct an EcoComply database from extracted material; or

  • use EcoComply datasets to populate another commercial database, platform or service.

The fact that individual facts, legislative provisions or publicly available environmental information may not themselves be owned by EcoComply does not remove any intellectual property or database rights that may subsist in EcoComply's original selection, arrangement, categorisation, presentation, explanation or compilation of that information.

5. Permitted Use

You may access and use EcoComply for legitimate personal, educational and professional reference purposes, subject to these Terms.

Reasonable use of information to support day-to-day environmental practice is permitted.

Unless otherwise expressly authorised in writing, access to EcoComply does not grant a licence to reproduce, redistribute, commercially exploit or systematically extract EcoComply materials.

6. Prohibited Use

Unless EcoComply has provided prior written permission, you must not:

  • reproduce substantial parts of EcoComply;

  • republish substantial parts of EcoComply;

  • redistribute EcoComply content;

  • sell or sublicense EcoComply material;

  • incorporate EcoComply content into another commercial product or service;

  • systematically copy or download EcoComply content;

  • systematically extract EcoComply information or datasets;

  • scrape the EcoComply website or platform;

  • harvest information from EcoComply;

  • use automated crawlers or extraction systems;

  • use browser automation for systematic extraction;

  • use software agents or automated systems to collect EcoComply information;

  • reproduce EcoComply's proprietary taxonomy or information architecture;

  • reproduce EcoComply's practitioner frameworks;

  • reproduce EcoComply decision pathways;

  • reproduce or imitate EcoComply's original database structures;

  • copy or imitate EcoComply's platform design for commercial purposes;

  • remove copyright, ownership or attribution notices;

  • falsely represent EcoComply material as your own;

  • use EcoComply branding without permission;

  • circumvent technical restrictions, access controls or other measures designed to protect EcoComply;

  • interfere with the operation or security of EcoComply; or

  • use EcoComply in a manner which infringes intellectual property rights or applicable law.

Nothing in these Terms is intended to prevent lawful use that cannot legally be restricted.

7. Artificial Intelligence and Automated Systems

Unless expressly authorised in writing, EcoComply content, databases, datasets and platform materials must not be systematically copied, scraped, extracted or processed for the purpose of:

  • training an artificial-intelligence system;

  • training a large language model;

  • fine-tuning an artificial-intelligence model;

  • machine-learning model development;

  • retrieval-augmented generation;

  • creating AI knowledge bases;

  • creating embeddings or similar systematic representations of EcoComply content;

  • benchmarking commercial AI systems;

  • building automated environmental compliance services;

  • populating another environmental knowledge platform; or

  • otherwise developing a commercial artificial-intelligence or machine-learning product using EcoComply material.

This restriction applies whether the extraction or processing is carried out directly or indirectly and whether undertaken manually, through software, through an API, by an automated agent or by another technical mechanism.

8. Competing Platforms and Commercial Reuse

EcoComply content, datasets, taxonomies, proprietary structures and practitioner frameworks must not be used without written permission to create, populate or materially develop a competing environmental knowledge, compliance, guidance or practitioner-reference platform.

This does not restrict lawful independent development based on a person's own expertise, publicly available information or material they are otherwise lawfully entitled to use.

The restriction concerns the unauthorised copying, extraction or reuse of protected EcoComply materials and intellectual property.

9. Third-Party Information

EcoComply may contain or refer to:

  • legislation;

  • statutory instruments;

  • regulator publications;

  • government publications;

  • professional guidance;

  • industry standards;

  • technical guidance;

  • academic research;

  • third-party websites;

  • published standards;

  • guidance documents; and

  • other external resources.

Ownership of third-party materials remains with the relevant rights holder.

The inclusion, citation, linking, summarisation or discussion of third-party material does not transfer ownership of that underlying material to EcoComply.

However, where applicable, EcoComply retains rights in its own:

  • commentary;

  • summaries;

  • explanations;

  • analysis;

  • categorisation;

  • structure;

  • comparison;

  • interpretation;

  • presentation; and

  • arrangement of information.

10. No Regulatory or Professional Body Endorsement

References to legislation, regulators, government departments, professional institutions, standards bodies, guidance organisations or other third parties do not imply endorsement of EcoComply by those organisations.

This includes references to organisations such as environmental regulators, statutory nature conservation bodies, local authorities, professional institutions and industry bodies.

Any trade marks or names belonging to third parties remain the property of their respective owners.

11. Environmental and Legal Information

Environmental legislation and regulatory requirements can vary significantly depending upon:

  • jurisdiction;

  • geographic location;

  • project type;

  • activity;

  • environmental sensitivity;

  • protected features;

  • contractual requirements;

  • planning conditions;

  • licences and permits;

  • regulator requirements; and

  • the particular circumstances of a project.

Environmental legislation, regulatory guidance and professional practice may also change over time.

EcoComply therefore does not guarantee that information will remain current indefinitely.

Users should verify current legal and regulatory requirements before relying upon information for a particular project or activity.

12. UK Jurisdictions

EcoComply may provide information relevant to one or more of the legal and regulatory jurisdictions within the United Kingdom.

Users must ensure that they are referring to information applicable to the correct jurisdiction.

Environmental legislation, terminology, regulatory systems, licences, permits, authorisations, exemptions and guidance can differ between:

  • Scotland;

  • England;

  • Wales; and

  • Northern Ireland.

Where EcoComply identifies information as jurisdiction-specific, users remain responsible for confirming that the relevant jurisdiction has been correctly identified for their activity or project.

13. Professional Responsibility

EcoComply is designed to support professional practice, not replace it.

Use of EcoComply does not discharge any:

  • statutory duty;

  • regulatory duty;

  • contractual obligation;

  • planning requirement;

  • environmental permit condition;

  • licence condition;

  • professional duty;

  • duty of care; or

  • organisational responsibility

owed by a user, employer, contractor, consultant, developer, client or other organisation.

Users remain responsible for exercising appropriate professional judgement.

Where appropriate, users should seek advice from suitably competent environmental professionals, ecological professionals, legal advisers, regulatory bodies or other relevant specialists.

14. No Professional Appointment

Use of EcoComply does not create a professional appointment, consultancy relationship or adviser-client relationship between EcoComply and the user.

In particular, EcoComply does not, merely through provision of information on the platform, assume the role of:

  • Environmental Clerk of Works;

  • Ecological Clerk of Works;

  • environmental consultant;

  • ecological consultant;

  • environmental manager;

  • waste adviser;

  • planning consultant;

  • legal adviser;

  • solicitor;

  • regulator; or

  • project-specific competent person.

Professional responsibility for project decisions remains with the appropriate individuals and organisations appointed to the project.

15. Regulatory Decisions and Authorisations

Information provided by EcoComply should not be treated as confirmation that:

  • an environmental permit is or is not required;

  • an exemption applies;

  • a waste activity is authorised;

  • a protected species licence is or is not required;

  • an environmental consent has been obtained;

  • an activity complies with planning requirements;

  • regulator approval has been obtained; or

  • a particular environmental control is sufficient for a specific project.

Where formal authorisation, consent or regulatory interpretation is required, users should consult the relevant competent authority or appropriately qualified professional.

16. Accuracy of Information

EcoComply aims to provide useful, accurate and professionally relevant information.

Reasonable efforts may be made to review, update and maintain platform information.

However, EcoComply does not warrant that all content will at all times be:

  • complete;

  • current;

  • accurate;

  • error-free;

  • applicable to every circumstance; or

  • appropriate for every project.

Information should therefore be considered alongside applicable legislation, current regulator guidance, project documentation and competent professional judgement.

17. Updates and Changes to Content

Environmental legislation, guidance and professional practice evolve over time.

EcoComply may therefore:

  • update content;

  • amend content;

  • correct content;

  • remove content;

  • replace content;

  • restructure information;

  • revise classifications; or

  • change platform functionality

without prior notice.

Previous versions of material should not automatically be assumed to remain current.

18. Availability of EcoComply

We do not guarantee uninterrupted or continuous access to EcoComply.

Access may temporarily be affected by:

  • maintenance;

  • software updates;

  • hosting issues;

  • technical faults;

  • security issues;

  • service-provider outages; or

  • circumstances outside our reasonable control.

EcoComply may also modify, suspend or withdraw particular features or areas of the platform.

19. User Decisions and Reliance

Users are responsible for decisions made using information obtained from EcoComply.

Where information could materially affect:

  • legal compliance;

  • environmental risk;

  • protected species;

  • pollution prevention;

  • environmental permitting;

  • waste management;

  • construction methodology;

  • regulatory compliance; or

  • contractual obligations,

users should independently verify the applicable requirements.

EcoComply should be used as a supporting practitioner resource, not as the sole basis for high-consequence professional decisions.

20. Limitation of Liability

To the fullest extent permitted by law, EcoComply and its owner/operator will not be liable for loss or damage arising from inappropriate or unreasonable reliance upon EcoComply information without appropriate consideration of project-specific circumstances.

Where permitted by law, this includes indirect or consequential loss, including:

  • loss of profit;

  • loss of business;

  • loss of opportunity;

  • loss of anticipated savings;

  • loss of data;

  • project delay;

  • contractual loss;

  • regulatory consequences; or

  • costs arising from reliance upon information which should reasonably have been independently verified.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

Nothing in these Terms affects statutory rights that cannot legally be excluded or restricted.

21. External Links

EcoComply may contain links to third-party websites and external resources.

These links are provided for convenience, reference or professional information.

EcoComply does not control third-party websites and is not responsible for their:

  • availability;

  • security;

  • accuracy;

  • content;

  • privacy practices; or

  • continued operation.

A link to another website does not necessarily imply endorsement of that website, organisation or its contents.

22. User-Submitted Information

Where EcoComply allows users to submit feedback, comments, research responses, suggestions or other information, users must not knowingly submit material that:

  • infringes another person's intellectual property rights;

  • contains confidential information they are not authorised to disclose;

  • is unlawful;

  • is defamatory;

  • is deliberately misleading; or

  • contains malicious software or code.

Submission of feedback or suggestions does not automatically transfer ownership of unrelated intellectual property belonging to the user.

However, EcoComply may use general feedback, ideas and suggestions concerning improvement of the platform unless otherwise agreed.

23. Research and Practitioner Feedback

EcoComply may undertake practitioner research, surveys or consultation to support platform development.

Where research responses are collected, the applicable privacy notice and any accompanying research information will govern the handling of personal information.

The existence of practitioner research or consultation does not confer ownership of EcoComply's platform, subsequent development, database, methodology or intellectual property upon research participants unless expressly agreed otherwise in writing.

24. Security and Misuse

Users must not knowingly attempt to:

  • gain unauthorised access to EcoComply;

  • access restricted areas;

  • interfere with platform security;

  • introduce malicious code;

  • test vulnerabilities without permission;

  • overwhelm or disrupt the service;

  • bypass access restrictions; or

  • interfere with other users' access.

EcoComply reserves the right to restrict or terminate access where misuse is reasonably suspected.

25. Suspension or Termination of Access

EcoComply may restrict, suspend or terminate access where a user materially breaches these Terms, including where there is reasonable evidence of:

  • intellectual property infringement;

  • systematic content extraction;

  • scraping;

  • unauthorised commercial reuse;

  • security interference;

  • misuse of the platform;

  • fraudulent activity; or

  • development of another service using unlawfully extracted EcoComply material.

This does not limit any other rights or remedies available to EcoComply.

26. Enforcement of Intellectual Property Rights

EcoComply reserves all rights and remedies available under applicable law in relation to unauthorised:

  • copying;

  • reproduction;

  • extraction;

  • reutilisation;

  • distribution;

  • publication;

  • commercial exploitation;

  • database extraction;

  • branding misuse; or

  • infringement of intellectual property rights.

Permission to reproduce or license EcoComply material must be obtained in writing.

Failure by EcoComply to immediately enforce a right does not constitute a waiver of that right.

27. No Waiver

If EcoComply does not immediately exercise a right or remedy under these Terms, that does not mean that the right or remedy has been waived.

Any waiver must be expressly agreed where required.

28. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall, where possible, be interpreted or limited to the minimum extent necessary.

The remaining provisions shall continue in effect.

29. Entire Agreement

These Terms constitute the terms governing use of EcoComply except where additional specific terms are expressly provided for a particular service, subscription, product or feature.

Additional commercial terms may apply if EcoComply subsequently provides paid subscriptions, organisational licences, enterprise access or other commercial services.

30. Changes to These Terms

EcoComply may update these Terms periodically to reflect:

  • changes to the platform;

  • changes in functionality;

  • changes in the commercial model;

  • changes in applicable law;

  • changes in intellectual property arrangements; or

  • changes in professional or regulatory requirements.

The date of the latest revision will be displayed at the top of this page.

Continued use of EcoComply following publication of updated Terms will constitute acceptance of those Terms where legally applicable.

31. Governing Law and Jurisdiction

These Terms and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the laws of Scotland.

Subject to any mandatory legal rights available to consumers or other users, the courts of Scotland shall have jurisdiction in relation to any dispute or claim arising from or connected with these Terms.

EcoComply may contain information relating to environmental law and regulatory systems elsewhere within the United Kingdom, but this does not alter the governing law applicable to these Terms.

32. Contact and Permissions

Questions concerning:

  • these Terms;

  • intellectual property rights;

  • licensing;

  • reproduction of EcoComply materials;

  • commercial use;

  • research;

  • data use; or

  • requests for permission

should be submitted through the EcoComply contact page.

Written permission must be obtained before any use for which these Terms expressly require consent.
